Kidzo Aquarium terms of use

§1. Service provider

The Kidzo Aquarium service is provided by [IMIĘ I NAZWISKO], [NAZWA FIRMY], [ADRES], NIP (tax ID) [NIP], e-mail: kontakt@kidzo.pl (“Kidzo”). These terms apply to people who send drawings to the aquarium (the “User”). Cooperation with Venues is governed by separate agreements.

§2. What the service is

  1. The User takes a photo of a Kidzo colouring sheet with a phone, and the fish from the drawing is shown in the aquarium on the screen at the Venue for about 15–30 minutes. Later it may briefly return to that Venue's screen when the aquarium is empty.
  2. To release a fish, the User types the number shown on the Venue's screen or asks the staff to do it.
  3. After sending, the User receives a “My fish” link, valid for 90 days, where they can watch and feed their fish.
  4. The service is free of charge for the User and requires no account.

§3. Rules

  1. The person who sends a drawing is responsible for its content.
  2. It is forbidden to send content that is unlawful, offensive, vulgar, sexual, promotes violence, hatred or totalitarian regimes, infringes the rights of others, as well as photos of people and personal data.
  3. By sending a drawing, the User declares that they have the right to share it (e.g. as a parent or guardian of the child who drew it) and agrees to it being shown on the screen at the Venue.
  4. Venue staff and Kidzo may remove a fish at any time without giving a reason.
  5. To protect against abuse, we record data of the device the drawing was sent from (details: privacy policy). In case of a breach of law, this data and the drawing may be handed over to the competent authorities.

§4. Rights to the drawing

Copyright in the drawing remains with its author. The User grants Kidzo and the Venue a non-exclusive, free permission to display the drawing in the Venue's aquarium and on the “My fish” page for the storage period (90 days). We do not use drawings in advertising or to train artificial intelligence models.

§5. Liability

We make every effort to keep the service running without interruption, but we do not guarantee its continuous availability — e.g. when the screen at the Venue is switched off. A fish may not appear if the photo is unreadable.

§7. Final provisions

These terms may change; the new version applies from its publication on this page. Matters not covered here are governed by Polish law. This does not exclude consumer rights under mandatory provisions of law.
